Transplant is the procedure of transferring an
organ from one body to another. The person who gives the organ such as heart,
kidney, liver, etc. is called the donors while the ones who receive it are
known as the organ receivers. The organ
donor can be alive or deceased. Most of us usually sign up for our organ to be
donated in case of any kind of calamity or accident, causing us death. There
are two types of donation which needs to be kept in mind as well- live donation
and cadaveric donation.
It is a very smart move as it helps thousands
who are out their fighting for their lives due to organ failure. Yet, to make
it legal and transparent, there are certain laws that one must be aware of.
Human organ transplant laws in India are one such law.
Steps involved:
The most common organs that are donated are
kidneys, liver, pancreas, lungs and sometimes the skin as well. Skin
trafficking along with other organs has been a major setback in the health
department. For ensuring that this doesn’t happen, the laws are introduced
which have certain rules and regulations that need to be followed while
organising an organ transplant
The most important rule to be followed is that
there can be no kind of financial exchange can take place between the receiver
and donor. The donor must file an affidavit stating that the organ is being
donated out of affection. They will also undergo a few lab tests, which will be sent to the authorisation committee to be
approved of.
According to our government, sale of any kind of
organ is strictly prohibited. If they are caught, then the fine and punishment
is severe. Family members and other close relatives can donate without going to
the government. However, they need to be approved by the committee of
authorisation.
